Terms and Conditions of Sale and Use
GENERAL PROVISIONS
These terms and conditions of sale and use (hereinafter, the "Terms and Conditions" or "T&Cs") apply, without restriction or reservation, to any online order for products (hereinafter, the "Order") placed with ROOMZEROZERO (hereinafter, the "Seller"), via its website (table00.com) (hereinafter, the "Website"), by consumers (hereinafter, the "Consumer Customer") or non-professionals (hereinafter, the "Non-Professional Customer"). The Consumer Customer and the Non-Professional Customer together, regardless of their status as consumer or non-professional, constitute the "Customer."
These Terms and Conditions govern the conditions under which the Seller sells its products to Customers via its Website, including the conditions for Orders, payment, delivery, and management of any returns of ordered products. The Seller invites the Customer to read them carefully and regularly. Use of the distance-selling process described in the Terms and Conditions is reserved for Customers who are of legal age, have full legal capacity, and are acting on their own behalf. Each Customer acknowledges meeting these conditions and indemnifies the Seller against any claim that may be made against it in this regard. Placing an Order constitutes full and unreserved acceptance of the prices and Terms and Conditions in the version in effect at the time the contract is formed, as well as an obligation to pay for the products ordered. These Terms and Conditions take precedence over any other terms. The Seller reserves the right to modify the Terms and Conditions at any time and without notice. However, such modifications will not affect Orders placed before their publication, and only the version of the Terms and Conditions in effect at the time the Order is placed will apply to that Order. The Terms and Conditions are accessible at any time on the Website and are systematically provided to any Customer who requests them.
PRODUCTS
The products covered by these Terms and Conditions are those featured on the Website and sold and shipped directly by the Seller (hereinafter, the "Products"). The Products and their essential characteristics are described on the corresponding page of the Website. It is the Customer's responsibility to take this into account before purchasing. The Seller may modify the characteristics or range of Products on the Website, as well as their presentation or packaging, at any time. These changes do not apply to orders placed before they are published online, unless required by law. Images or photographs of the Products shown on the Website are provided for indicative purposes only. The Seller strives to present images of the Products and their colors as accurately as possible. However, the Products may differ slightly from these images. Sales are made subject to the Seller's available stock.
PRICE
The price shown on the Product page is the price in euros, inclusive of all taxes (VAT included), excluding shipping costs — unless stated otherwise — and takes into account any discounts applicable and in effect on the day of the Order. The price shown does not include delivery charges, which will be invoiced separately. These will be calculated before the Order is placed and detailed, along with VAT, in a summary before the Order is finalized. The payment requested from the Customer corresponds to the total purchase amount, including VAT and delivery charges. Prices may be changed at any time without affecting Orders already accepted by the Seller. Under no circumstances may a Customer demand the application of discounts that are no longer in effect on the day of the Order. In the event that pricing information shown on the Website is manifestly incorrect and this error is known, or, due to the obvious nature of the error, should have been known, by the Customer, the Seller reserves the right to update the Order with the correct price or to cancel the Order by simple notification, without any additional costs or compensation owed by the Seller other than the refund of the price paid by the Customer for the Product concerned.
ORDERS
Orders are placed by the Customer directly on the Website based on the offers whose terms are indicated on said Website. Offers are valid for as long as they are visible on the Website, subject to the availability of the Product as indicated. These offers, excluding promotional offers, may be modified at any time and without notice by the Seller. All promotional offers are subject to the specific duration conditions stated on the Website. Promotional offers cannot be combined with other current offers.
Placing an Order on the Website is subject to the Customer's free registration and completion of the online payment process. Registration is automatically generated when an Order is placed, or it can be completed before placing an Order. The Customer guarantees and represents, on their honor, that all information provided on the Website, particularly during registration, is accurate and correct. The Customer undertakes to update their personal information via the dedicated page available in their account.
Each registered Customer has a username and password. These are strictly personal and confidential and must never be disclosed to third parties, under penalty of the offending Customer's account being deleted. Each registered Customer is personally responsible for maintaining the confidentiality of their username and password. The Seller cannot under any circumstances be held liable for identity theft of a Customer. If a Customer suspects fraud at any time, they must contact the Seller as soon as possible so that the Seller can take the necessary measures and resolve the situation. Each Customer may hold only one account on the Website.
In the event of non-compliance with the Terms and Conditions, in particular the creation of multiple accounts by a single person or the provision of false information, the Seller reserves the right to temporarily or permanently delete all accounts created by the offending Customer. Deletion of the account results in the definitive loss of all benefits acquired on the Website. However, any Order placed and invoiced on the Website before the account is deleted will be fulfilled under normal conditions. In the event that an account is deleted by the Seller for failure to comply with the duties and obligations set out in the Terms and Conditions, the offending Customer is strictly prohibited from re-registering on the Website, whether using a different email address or through a third party, without the Seller's express authorization.
The Order process on the Website proceeds as follows:
The Customer browses the Website and selects Products by filling their cart. To do this, the Customer must click on the chosen Product and on the "add to cart" icon. Adding the Product to the cart does not constitute a reservation of the Product.
When the Customer wishes to place their Order, they click on the cart icon. The Customer then has the option to review and modify the selected Products. If any changes are made, the Customer clicks "update cart." At this stage, the Customer may also add a promotional code. The Customer chooses the desired delivery type from the options available based on the Order's destination. The Customer can also calculate an estimate of delivery costs for signature-required delivery by clicking "calculate shipping costs" and entering an address.
Once the Customer has reviewed the contents of their cart and chosen a delivery method, they must click "confirm order." A summary page then opens, allowing the shipping method chosen to be modified and again offering the option to enter a promotional code. If the Customer is entitled to such a code, they must enter it at this stage if they have not already done so. The Customer may not request any credit or refund from the Seller if they failed to mention the promotional code before proceeding to payment for their Order.
The summary page also shows the total price of the Order, i.e., the price of the Product plus VAT and delivery charges; this is the amount the Customer must pay.
The Customer must provide their billing details. They enter the personal data necessary to place the Order, namely: first name, last name, company name (optional), postal address (street number and name, postal code, city), phone number, and email address. If the delivery information differs from the billing information, the Customer must indicate this. In that case, they must enter: first name, last name, company name (optional), postal address (country/region, street number and name, city, postal code). Notes may be added to the Order.
After reviewing the Order summary and their personal data, the Customer must then read these Terms and Conditions by clicking on the words "terms and conditions" displayed in blue above the "order" icon. The Customer must read them and check the box "I have read and accept the terms and conditions."
In accordance with the provisions of Article L 221-14, paragraph 2, of the French Consumer Code, the Order summary clearly indicates to the Customer the payment obligation resulting from the Order validation process, through the words "order with payment obligation." The Customer then clicks "Order."
The merchant server then displays all accepted payment methods. The Customer may pay on the Website by credit/debit card. To do so, the Customer must click on the card payment icons. The Customer is then directed to the secure payment server. They must enter the card number, expiry date, and the security code (CVV) of their card. After receiving the authorization response, the Order is confirmed and an Order number is assigned.
An email is then automatically sent to the Customer's email address summarizing the contents of the Order and providing the Order number.
A sales contract is concluded between the Customer and the Seller at the moment the Seller provides the Customer with written confirmation of acceptance of the Order and after the Seller has received payment in full. Finalizing the Order implies acceptance of the Terms and Conditions, the prices of the Products sold, and the delivery terms and timeframes indicated on the Website. The Seller cannot be held liable for errors in the information entered by the Customer, nor for any resulting delivery delays or errors.
In accordance with the provisions of Article L 121-11 of the French Consumer Code, the Seller is entitled to refuse any Order for legitimate reasons.
PAYMENT TERMS
Unless otherwise stated, all sales are paid for in full at the time the Order is placed. Depending on the nature or amount of the Order, the Seller remains free to require a deposit or full payment of the price when the Order is placed or upon receipt of the invoice. Payment may be made by (i) credit/debit card, via a secure connection, in a single payment.
The Customer will be charged the full amount shown in the Order summary. The Customer guarantees to the Seller that they are fully authorized to use the chosen payment method for their Order and that this payment method legally provides access to sufficient funds to cover all costs resulting from their Order on the Website. The Seller cannot be held liable for any fraudulent use of the payment method used.
Online payment for Orders is processed using a secure system in partnership with LCL. In order to guarantee the highest level of security for its Customers, banking information entered on the Website is automatically encrypted upon entry. No additional fees, exceeding the costs borne by the Seller for the use of a payment method, may be charged to the Customer. An invoice is issued by the Seller based on the information provided by the Customer. It is sent electronically to the address provided when the Customer registered.
DELIVERY
Ordered Products are delivered against signature, to the address provided by the Customer, exclusively within the following geographic areas:
Metropolitan France including Corsica (excluding overseas territories) European Union Switzerland
The delivery charges applied to the Order depend on the transport costs specific to each delivery. Delivery consists of the transfer to the Customer of physical possession or control of the Product. Except in special cases or where one or more Products are unavailable, ordered Products will be delivered in a single shipment. The Seller undertakes to make every material and human effort to ensure the Products ordered by the Customer are delivered as promptly as possible. Delivery times may vary depending on the Customer's geographic area, the delivery method chosen, or the Product ordered.
If the delivery deadline of ninety (90) days is exceeded, for any reason other than force majeure or the Customer's own actions, the sale may be cancelled at the Customer's written request under the conditions set out in Articles L. 216-6, L. 216-7, and L. 241-4 of the French Consumer Code. Any amounts paid by the Customer will then be refunded no later than fourteen (14) days after the date the contract is terminated, excluding any compensation or deduction. In the event delivery is impossible due to an error in the address provided by the Customer, the Seller will contact the Customer as soon as possible to obtain a new delivery address. Any additional delivery costs will be borne by the Customer.
Furthermore, the Seller's liability cannot be engaged for reasons related to delivery delays:
during periods of high demand, such as the end-of-year holiday season during periods when the supplier is closed (Christmas holidays, Easter holidays, and August) for delays caused by force majeure as defined in Article 15 of these Terms and Conditions
TRANSFER OF RISK AND OWNERSHIP
The Seller retains ownership of the Products sold until the price has been paid in full by the Customer, regardless of the delivery date of said products. The Seller may therefore repossess said Products in the event of non-payment.
Transfer of risk occurs when the Customer takes physical possession of the Products, i.e., upon delivery or upon collection where the Customer has chosen to collect the Products from the Seller's store.
CONSUMER RIGHT OF WITHDRAWAL
In accordance with the provisions of the French Consumer Code, the Customer has a period of fourteen (14) days from the day after receipt of the Product to exercise their right of withdrawal with the Seller, without having to justify their decision. The right of withdrawal does not apply to contracts referred to in Article L 221-28 of the French Consumer Code. If Products from the same Order are delivered in multiple shipments, the withdrawal period begins upon receipt of the last Product ordered.
To exercise this right of withdrawal, the Customer must send a statement in accordance with the template provided in the Appendix, to the following email address: contact@table00.com, indicating in the subject line: "Withdrawal Request - Order #YourOrderNumber."
Products must be returned in their original packaging and in new (unused) condition within fourteen (14) days from the date on which the Customer notified the Seller of their decision to withdraw. In accordance with the provisions of Article L 221-23 of the French Consumer Code, the Customer may be held liable for any depreciation of the Products resulting from handling other than that necessary to establish the nature, characteristics, and proper functioning of these Products. Products that are damaged, soiled, incomplete, or unfit for resale will not be accepted back by the Seller.
If the Customer fails to return the Products within fourteen (14) days of notifying their decision to withdraw, the Order will be deemed final and no refund will be issued, except in cases provided for in these Terms and Conditions. In the event of a valid exercise of the right of withdrawal, the Seller undertakes to refund the Order in full (including delivery charges), with return shipping costs remaining the Customer's responsibility.
To find out how to return ordered Products, the Customer is invited to contact the Seller's customer service. The Customer will be refunded the full amount paid for the Order within fourteen (14) days following receipt of the returned Product(s) or proof of shipment of the Product by the Customer. The refund will be made using the same payment method used for the purchase. The burden of proving the effective exercise of the right of withdrawal rests with the Customer.

STATUTORY WARRANTIES
All Products sold on the Website are covered, automatically, at no additional cost, and independently of the right of withdrawal, by (i) the statutory two (2) year warranty against lack of conformity in accordance with the provisions of Articles L 217-3 et seq. of the French Consumer Code, and (ii) the statutory warranty against hidden defects in accordance with the provisions of Articles 1641 et seq. of the French Civil Code.
(i) Statutory Warranty of Conformity
It is recalled that, under the statutory warranty of conformity and in the event a Product is delivered that does not conform, the Consumer Customer:
- has a period of two (2) years from delivery of the Product to bring a claim against the Seller
- may choose between repair or replacement of the Product ordered, subject to the cost conditions set out in Article L. 217-12 of the French Consumer Code
- is exempt from having to prove the existence of the lack of conformity of the Product during the twelve (12) months following delivery of the Product for second-hand goods, and during twenty-four (24) months for new goods.
The statutory warranty of conformity (Article L.217-3 et seq. of the French Consumer Code) applies independently of any commercial warranty that may cover the Product.
(ii) Warranty Against Hidden Defects
It is recalled that, in accordance with the provisions of Articles 1641 et seq. of the French Civil Code, when the Product has a hidden defect at the time of purchase, the Customer may choose between rescission of the sale or a reduction in the sale price, in accordance with Article 1644 of the French Civil Code. To this end, the Customer may, in particular, return the Product and obtain a refund of the price from the Seller within a period of two (2) years from the discovery of the defect. In the event of a hidden defect in the Product, the Customer is invited to contact the Seller's customer service to arrange the return of said Product for examination by the Seller. If the hidden defect is confirmed, the Customer may obtain a refund of the purchase price of the Product, or a partial refund if the Customer wishes to keep the Product, in which case the Seller will return the Product to the Customer at its own expense.
The warranty against hidden defects (Articles 1641 and 1649 of the French Civil Code) applies independently of any commercial warranty that may cover the Product.
(iii) Refund and Liability
Refunds for Products deemed non-conforming or defective will be made as promptly as possible and no later than fourteen (14) days after the Seller has confirmed the lack of conformity or hidden defect. The refund will be made using the same payment method used for the purchase.
The Seller cannot be held liable in the event of misuse, negligence, or lack of maintenance by the Customer, nor in the event of normal wear and tear of the Product, accident, or force majeure, in accordance with Article 15 of these Terms and Conditions.

Article L 217-4 of the French Consumer Code: "Goods conform to the contract if they meet, where applicable, the following criteria:
1° They correspond to the description, type, quantity, and quality, in particular with regard to functionality, compatibility, interoperability, or any other characteristic provided for in the contract
2° They are fit for any special purpose sought by the consumer, made known to the seller at the latest at the time of conclusion of the contract, and which the seller has accepted
3° They are delivered with all accessories and installation instructions to be provided in accordance with the contract
4° They are updated in accordance with the contract."
Article L 217-5 of the French Consumer Code: "I. In addition to the criteria of conformity with the contract, goods conform if they meet the following criteria:
1° They are fit for the purpose for which goods of the same type are ordinarily used, taking into account, where applicable, any provision of European Union law and national law, as well as any technical standards or, in the absence of such technical standards, the specific codes of conduct applicable to the sector concerned
2° Where applicable, they possess the qualities that the seller presented to the consumer in the form of a sample or model, before conclusion of the contract
3° Where applicable, any digital elements they include are supplied in the most recent version available at the time of conclusion of the contract, unless the parties agree otherwise
4° Where applicable, they are delivered with all accessories, including packaging, and installation instructions that the consumer may legitimately expect

II. However, the seller is not bound by any public statement referred to in the preceding paragraph if it demonstrates:
1° That it was not aware of it and could not reasonably have been aware of it
2° That, at the time the contract was concluded, the public statement had been corrected in a manner comparable to the way in which it was made, or
3° That the public statement could not have influenced the decision to purchase.
III. The consumer may not dispute conformity by invoking a defect concerning one or more particular characteristics of the goods, of which they were specifically informed departed from the conformity criteria set out in this article, and to which departure they expressly and separately consented at the time of conclusion of the contract."
Article L 217-7 of the French Consumer Code, paragraphs 1 and 2: "Any lack of conformity that becomes apparent within twenty-four months of delivery of the goods, including goods with digital elements, is presumed, unless proven otherwise, to have existed at the time of delivery, unless this presumption is incompatible with the nature of the goods or of the defect invoked.
For second-hand goods, this period is set at twelve months."
Article L 217-8 of the French Consumer Code: "In the event of a lack of conformity, the consumer is entitled to have the goods brought into conformity by repair or replacement or, failing that, to a price reduction or termination of the contract, under the conditions set out in this subsection.
The consumer is also entitled to suspend payment of all or part of the price, or delivery of the benefit provided for in the contract, until the seller has fulfilled its obligations under this chapter, under the conditions of Articles 1219 and 1220 of the Civil Code. The provisions of this chapter are without prejudice to the award of damages."
Article L 217-12 of the French Consumer Code: "The seller may decline to proceed according to the consumer's choice if the requested remedy is impossible or entails disproportionate costs, having regard in particular to:
1° The value the goods would have in the absence of the lack of conformity
2° The significance of the lack of conformity, and
3° The possibility of opting for the other remedy without major inconvenience to the consumer.
The seller may refuse to bring the goods into conformity if doing so is impossible or entails disproportionate costs, in particular having regard to points 1° and 2° above.
Where these conditions are not met, the consumer may, after formal notice, pursue specific performance of the remedy originally requested, in accordance with Articles 1221 et seq. of the Civil Code.
Any refusal by the seller to proceed according to the consumer's choice, or to bring the goods into conformity, must be justified in writing or on a durable medium."
Article L 217-13 of the French Consumer Code: "Any goods repaired under the statutory warranty of conformity benefit from a six-month extension of that warranty.
Where the consumer chooses repair but the seller does not carry it out, bringing the goods into conformity by replacement gives rise, for the benefit of the consumer, to a new statutory warranty of conformity period applicable to the replaced goods. This provision applies from the day the replacement goods are delivered to the consumer."
Article 1641 of the French Civil Code: "The seller is bound by a warranty on account of hidden defects in the item sold which render it unfit for its intended use, or which so impair that use that the buyer would not have acquired it, or would only have paid a lower price for it, had they known of them."
Article 1644 of the French Civil Code: "In the cases covered by Articles 1641 and 1643, the buyer has the choice of returning the item and having the price refunded, or keeping the item and having part of the price refunded."

COMPLAINTS
For all Orders placed on the Website, the Customer has fourteen (14) days from delivery of the Product to raise a complaint. It is the Customer's responsibility to check the apparent condition of the Products upon delivery. In the absence of reservations expressly made at the time of delivery, the Products are deemed to conform to the Order.
To exercise this right to complain, the Customer must send the Seller, via the email address contact@table00.com, a statement setting out their reservations and complaints, together with supporting documents (delivery note countersigned by the carrier, photographs, etc.).
Failure to comply with these formalities means the Products will be deemed to conform, free from any apparent defect, and no complaint will be validly accepted by the Seller. The Company will repair, replace, or refund, as promptly as possible and at its own expense, any delivered Products whose lack of conformity or apparent defects have been duly proven by the Customer, under the conditions set out in Articles L. 217-3 et seq. of the French Consumer Code and those set out in these Terms and Conditions, subject to the material possibility of repairing the Product or its availability in stock.
PERSONAL DATA
In accordance with Law 78-17 of 6 January 1978, as amended by Law No. 2018-493 of 20 June 2018, the personal data requested from the Customer is strictly necessary for processing their Order and issuing invoices. Personal data provided by the Customer will be collected, processed, and stored in accordance with the provisions of that law. This data may be shared with any partners of the Seller responsible for fulfilling Orders. In accordance with the French Data Protection Act of 6 January 1978, as strengthened and supplemented by the General Data Protection Regulation ("GDPR"), which came into force on 25 May 2018, the Customer has, at any time, the right to access, query, rectify, object to, restrict, erase, and port all of their personal data by writing, by email, and proving their identity, to the following address contact@table00.com, indicating in the subject line of the email "Personal data - last name first name."
In the event of a dispute regarding the processing of data, the Customer has the right to lodge a complaint with a supervisory authority.
TERMINATION
In the event the Customer fails to comply with any of their obligations, the Seller may terminate the relevant Order automatically and without notice, in whole or in part. The Seller will inform the Customer as soon as possible.
LIABILITY
The Seller cannot under any circumstances be held liable for the unavailability of the Website, whether temporary or permanent, and, although it uses every means to ensure the service is available at all times, the service may be interrupted at any time. Furthermore, the Seller reserves the right, through a deliberate act, to make the Website unavailable in order to carry out any update, improvement, or maintenance operation. Subject to the provisions relating to defective products, the Seller's liability is strictly limited to compensation for direct personal injury and property damage, proof of the existence of which and of the causal link must be provided by the Customer. The Seller cannot be held liable for any loss of profit, loss of business, business interruption, or loss of business opportunity if the Customer uses the ordered Products for commercial, professional, or resale purposes. In all cases, purchased Products must be installed and used in strict compliance with the user manual for the Product concerned. The Seller cannot be held liable for any complaint resulting from improper use or installation of the Product.
FORCE MAJEURE
Under the provisions of Article 1218 of the French Civil Code, force majeure occurs where an event beyond the debtor's control, which could not reasonably have been foreseen at the time the contract was concluded, and whose effects cannot be avoided by appropriate measures, prevents the debtor from performing its obligation. This includes, in particular but without limitation, war, riots, insurrection, civil unrest, pandemics, strikes of any kind, and supply issues affecting the Seller. The Seller cannot be held liable for any failure or delay in fulfilling the Order if such failure or delay results from a case of force majeure.
The Seller will inform the Customer within seven (7) days of the event occurring. The Seller's obligations will be suspended for the duration of the force majeure event. If the event continues for a period exceeding thirty (30) days, the Customer or the Seller may terminate the contract with immediate effect by notifying the other party in writing. In this case, the Seller will refund all amounts paid by the Customer for the cancelled Order.
INTELLECTUAL PROPERTY
The trademark, logo, and visual identity of this Website are trademarks registered with the INPI (French National Institute of Industrial Property) and works protected under copyright law, ownership of which belongs exclusively to the Seller. Any distribution, exploitation, representation, or reproduction, whether partial or complete, without the Seller's express authorization, is strictly prohibited and will expose the offending party to civil and criminal proceedings.
The Seller holds all property rights attached to the Website and its component elements and has the required licenses. The Seller holds all intellectual property rights and derivative rights attached to the concepts and editorial content used and/or published on the Website. Generally speaking, no provision of these Terms and Conditions may be interpreted as granting the Customer, expressly or implicitly, any right whatsoever (under a license or by any other means) to the Seller's names, trademarks, acronyms, logos, or other distinctive signs, except for the rights held by the Seller's suppliers and any partners over images of their Products, and over their trademarks and logos displayed on the Website. Furthermore, the Seller remains the owner of all intellectual property rights in the photographs, presentations, designs, and models produced for the purpose of supplying the Products to the Customer. The Customer therefore agrees not to reproduce or exploit these elements without the Seller's prior express written authorization, which may be made subject to financial compensation.
CONTACT
For any information relating to their Order, the Customer may contact the Seller by email: contact@table00.com.
MEDIATION
In the event of a dispute, the Customer, as a consumer, has the option, before taking any legal action, to use a conventional mediation procedure or any other alternative dispute resolution method, under the conditions set out in Article L.211-3 of the French Consumer Code.
In accordance with Article 14 of Regulation (EU) No. 524/2013 of the European Parliament, the European Commission provides consumers with an online dispute resolution platform, accessible via the following link:
http://ec.europa.eu/consumers/odr/, to enable out-of-court settlement of contractual disputes relating to online purchases and services.
It is a reminder that recourse to mediation is only possible if the complaint has not already been examined by a judge or another mediator and has already been the subject of a request to the Seller's after-sales service.
LANGUAGE – APPLICABLE LAW
These Terms and Conditions are drafted in French. In the event they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute. The Terms and Conditions and the transactions arising from them are governed by and subject to French law. In the event any attempt at mediation fails, all disputes arising out of or in connection with the contract will be adjudicated in accordance with French law and submitted to the jurisdiction of the Seller's registered office.
